The end of the term arrives, and the Court is busy. We begin our dive into the cases with Mahmoud v. Taylor, a case involving inclusive books in a school, parental guidance of religious education, opt-outs, advance notification, and issues of gender and sexual education. Professor Amar goes beyond the case with an overall theory of religious accommodation; indeed, he goes beyond this into questions of parental rights and how it may interact with first amendment law. Akhil: suppose you are at a law conference, and you are conversing with other legal theorists. And you are introduced to a new hire at Yale Law School. You come to the realization that they are trans. In response to that realization, you say to them, and to all others present who are listening: “That’s weird. You can’t be a girl, if you were born a boy”. My intuitive reaction to this is that you are saying something that is publicly demeaning to this trans person. It’s hurtful to them. So…why not the kid in grade school who responds the same way to the trans kid, when realizing that they are trans?! The podcast I recommended, by the way, is 5-4.

Grade school kids are inundated with celebratory messages about heterosexual marriage, parenthood, family, romance, and eroticism ALL THE TIME. But when they’re exposed to a single celebratory message about two men getting married, Akhil calls this “indoctrination”. Gimme a break! The parents who are wanting to opt their children out tend to be ones who are trying to prevent their kids from having access to any positive information about LGBT people. They only want them to have access to negative information. It’s motivated by a caste system where LGBT are demeaned, and heterosexuals are exalted. Religion is typically just a cover or protective shield for it.
